1. Do I need a permit to remove a tree?

Answer

Yes. In fact, you need a permit to relocate, remove or prune 25% or more off a tree canopy or root system. Please contact your area Code Enforcement Office for more information. If the tree is located on the right of way, please contact the Department of Public Works at 305-416-1200.

2. What is considered an inoperable/untagged vehicle?

Answer

Any vehicle in the City of Miami that does not have a valid tag or has an expired tag.

3. How do I know if I have an illegal unit?

Answer

You must first request a file search/tax card from the City of Miami microfilm section of the Building Department and do a comparison as to what is on paper and what is physically at the location. Visit one of our offices for assistance.

4. Q. I have been cited for having an illegal unit. How do I legalize an illegal unit?

Answer

Refer to your Code Enforcement Inspector for assistance and make sure you keep in touch with your Code Enforcement Inspector. Follow all instructions he/she gives you to legalize the violation.

5. Q. How do I know when I need a building permit?

Answer

Generally when the work costs over $500 however, contact the Building Department at 305-416-1100.

6. Q. I have been cited with not registering my vacant property. How do I comply?

Answer

Within the City of Miami it is required to register a vacant structure or vacant lot. To register, visit your Neighborhood Enhancement Team (NET) or call 305-960-4NET

7. Q. What are the requirements to operate a business in the City of Miami?

Answer

To operate a business in the City you must apply for a Certificate of Use (CU) and a Business Tax Receipt (BTR)

10. Q. Can I repair my vehicle at home?

Answer

No all mechanical repairs must be done at a repair shop.

11. Q. Can I own a rooster?

Answer

No. Roosters are prohibited in the City of Miami for more information, visit www.municode.com

12. Q. I have a company truck. Can I legally park it in my driveway?

Answer

Commercial vehicles are not allowed in residential zones.

13. Q. How can I contact a Code Inspector in my area?

Answer

All Code Enforcement Inspectors are in their respective areas 8:00 AM to 5:00 PM. Please see our contact page.

14. Q. I am repairing the fence in my property do I need a permit?

Answer

If you are repairing your fence with the same material and the area being repaired is less than five feet, you do not need a permit. However if you do not meet said criteria, you must apply for a permit.

19. Q .I want to sell flowers. What are the requirements?

Answer

Depends. If from a vehicle, a peddlers license can be obtained by submitting the following:

  • Three photos of the vehicle showing the front, side and rear
  • A copy of your registration
  • Copy of your driver’s license
Always remember a peddler’s license is for the vehicle to be moving until stopped for a sale and not remain in one spot. If you are opening a store front, see question 8 on obtaining a BTR/CU If a flower cart, on public right of way, you must apply with Public Works for approval. If a flower cart is located in a gas station, the property owner must apply for a Warrant permit at Zoning.

20. Q. My neighbor and I are planning garage sale this weekend what are the requirement?

Answer

Yard sales/garage sales are permitted twice per year as long as you apply for permit fee of $28.50 at the NET office or Miami River Center (MRC) Zoning Office 4th floor.

21. Q. Someone dumped trash onto my property but I was cited. Why?

Answer

While it is illegal to place trash onto someone else's property, it is ultimately the property owner's responsibility to maintain their lot in a clean condition, including the swale. To report illegal dumping, please call 311.

22. Q. How can I find out if my property has a lien or a code enforcement violation?

Answer
